Is 23-channel CB radio still viable?

Getting ready to install a CB in the YJ. I have an old 23-channel Midland that I used years ago when CBs were a real craze (mid-70's) and it served me well. In fact it was tuned up, tweeked and had a powermike for a clear, clean signal.

The question becomes, should I look to get a 40-channel or are highway and trail channels on the lower 23?
 

Use it if you got it. You can always tell your buddies to run 23 or lower.
 
Should still be good. No reason not to use it.
So I know it used to be, but now...the channels above 20 used to be "reserved" for people committing nefarious deeds. Does this count?
 

nothing wrong with the old 23 channel radios. nothing at all. mine has 320 channels and everything in between.
