got my judgement from JEEP civil suit - now what? help!

hey all -

for those who haven't been following the fun story involving my recent jeep purchase and consequent legal action against the seller, i'll break it down in short form:

bought jeep on ebay, description stated the floor of the jeep was rusted out, but repaired and completely fixed... didn't pass PA state inspection, needed a whole new floor welded in. filed a civil suit in York, PA (where we transferred title) and am waiting for my judgment paperwork to come in the mail. (seller resides in Bel Air, MD).

so my question... how do i make them pay? they didn't even fight me in court, and they're out-of-state. could i have a sherrif's sale in MD?

Bel Air is about 20 minutes from me... I could go get it out of them for a fee :twisted:

No seriously now... If you were awarded a judgement, you can contact them. If they do not pay you you can then file to garnish their wages. Let them know that paying you will keep them from further destroying their credit rating. The judgement is already on there and the garnishment will be as well if you need to take that route. They'll be hard pressed getting any credit with a garnishment on there.

Winning that judgement put all the cards in your hand ;)

That's disappointing... I practically grew up in and around Bel Air (from age 11 on).

That could be tough.. I mean making them pay.
A judgement does not always equal money. If you feel they won't pay, you can take your judgement and file a series of writs.

You can also file the judment in the county courthouse where they live and in some cases they will not be able to sell any real estate property until that is cleared up. Judgements are discovered as part of a title search when you buy a home or land. to make sure the seller does not have any liens. It scares a buyer right off for sure.

Also, rememeber these important words:

"The man who acts as his own lawyer has a fool for a client"

I heard a lawyer tell my friend that after he tryed to defend himself in small claims court then had to go to district court to get cleared by a lawyer.

Its a mess out there...good luck!
 
i mean, if a lawyer has a better chance of getting this money than i do, tell me! i'll gladly pay a portion of my $3500 judgement to get a check in my hand without having to do anything else!
 

Unfortunately, using a lawyer could cost you as much as half of that $3500. I'd file to garnish their wages if they refuse to pay.

No need for an attorney. You can do anything a lawyer can do to collect your money. You can garnish wages, attach property (have his car sold at auction) put a lien on his house. These are all things that the lawyer would/could do. Your clerks office where you filed should be able to give you info on how to do it. That quote about a fool for a lawyer is more for a Defendant.

Right you are, south. I meant to add that to my post about being able to do the garnishment thing, as well as other stuff.

Right, for the most part... I've done all my own defense myself. Though it was never anything very major, always traffic stuff if anything. I've never HAD TO use a lawyer for anything. The one time I did use one, he just did something I was going to do anyway, and got a large chunk of money that should have gone to me. He stepped in as a middle man and did some things without my permission and ended up getting paid at my expense.
